The Thai legal system can be complicated, and while there is a straightforward legal procedure that must be followed, ensuring that bail is posted and the defendant is actually released in a timely manner almost always requires a registered Thai lawyer to be present.

The amount of bail in Thailand varies from case to case. For example, bail for a simple theft case usually ranges from 50,000 - 200,000 Thai baht, with bail for theft at night being higher than theft during the day time. Bail for attempted murder charges usually ranges from 200,000 - 1,000,000 Thai baht. Drug case bail depends on the type and quantity of drug. For example, drug use usually requires bail not exceeding 50,000 Thai baht and can sometimes be as low as 10,000 Thai baht. However, possession with intent to sell, import/export, and similarly serious drug charges can require bail of up to 2,000,000 Thai baht.

The vast majority of cases (99%) follow the 48-hour rule, whereby an accused person must be brought before a judge within 48 hours of arrest.
