Thailand Bail was in the Southern Criminal Court of Thailand on 08 August 2013 for the sentencing of two of our clients, an American citizen and a Malaysian national. Our legal team in Bangkok had been doing much preparatory work in the weeks leading up to the judge reading the sentence, so we were able to predict the outcome of the judge’s ruling. Each of our clients in this case were facing up to four (4) years in Thai prison as well as a fine of 40,000 Thai baht ($1,300 USD). In addition to this, our clients had already confessed to the crime. We were faced with a challenging situation, especially since our clients were foreigners. However, due to weeks of hard work, our clients received a suspended sentence (no jail time) and a small fine. The fine was deducted from their bail money, and the Bangkok court allowed them to legally leave the country two (2) days later. As of today, they have left Thailand without incident.

BACKGROUND

This case was unique for Thailand Bail’s Bangkok lawyer team. We received a request from our clients within twenty-four (24) hours of their arrest, when they were still being held in the Royal Thai Police Station’s holding cell. Our firm was able to post bail for these defendants, and they were able to stay in the comfort of a hotel while their case progressed. We offered our services to them for the remainder of the case, but they declined. After about a month, we heard back from these 2 defendants – they were in trouble again. They were unable to work their own case, since they did not understand Thai legal procedure. They were facing four (4) years in prison each plus fines. They had spent a few days in Thai jail before and did not want to go back. In addition to the proven theft and confession, our clients (during the time in which they decided to not consult a legal team) had violated a court order unknowingly by failing to return their passports to the court on the required date. This could have had serious implications, as the Southern Criminal Court of Bangkok is quite strict about its regulations, and the court could have had them re-arrested for this offense.

RESULT

Our clients were accused of theft at one of Bangkok’s top shopping malls, and the stolen items were recovered from the hotel room of our clients. In addition, the defendants had already confessed to the crime. This posed a significant challenge to our Bangkok lawyer team, but we were able to overcome it and win the case.
