This Thailand Bail success story comes from Udon Thani, Klong Prem, and a very serious case that we took on. Our client was a foreigner who had been charged with attempted murder by the police and the Udon Thani Provincial Court. The case was difficult because the prosecutor had four (4) witnesses who were willing to come to the court and testify against our client. Indeed, all 4 of the witnesses came to the court and gave compelling testimony that our client had tried to kill two Thai people. On our side, we only had the defendant himself, since no one else was present when the incident happened. To make matters worse, we took not he case late in the legal process, as there had already been one lawyer who had handled the case through the police investigation period as well as two pre-trial court hearings. This meant that we were not able to influence the police investigation period with positive evidence to support the accused person and were not able to assist with the pre-trial court hearings. We had to undo a lot of the poor work of the previous attorney, so we had our work cut out for us. Despite the clear challenges, Thailand Bail was able to put together a capable defense for our client, resulting in a clear win – a judgment of no prison time, a small fine, and probation time!
Preparing for Trial
Thailand Bail assigned its best lawyers, interpreters, and other experts to work on this case. We knew that we were facing a difficult situation. The defendant was a white male, and the injured parties were two Thai women, one of which was elderly. This automatically looked bad to the court, with the big, white farang (foreigner) being accused by two Thai ladies of trying to kill them. We put in significant time to prepare for trial, going over all points and examination details with the defendant. We prepared him by going through our logic and line of questioning, as well as preparing him for the prosecutor’s cross examination. Most Thai lawyers do not do this, or if they do, they wait until the last minute to do so, not allowing any time to make corrections or find additional evidence.
In addition to this, we prepared as much evidence as we could to show what really happened, or what we were told by our client happened. Thailand Bail’s job is to fight for our client, and as long as we know about some detail, we can plan for it. We encourage all clients to tell us as much as possible, good or bad, so that we can prepare for it in trial.
Finally, we also put in over 100 hours of preparation with the Probation Office of Thailand, in order to show them our side of the story. We simply out-worked the prosecutor on this case, and got most stakeholders to see our side of the story. This paid off in a huge way.
Trial
For the two (2) full days of trial, we executed our plan perfectly and succinctly, clearly showing our key points to the judge. Our cross-examination of the prosecutor’s witnesses was excellent and our questioning of the defendant showed the court our side of the story.
Judgment / Verdict
In March 2019, we received the final verdict for this case, which was an outstanding result of no prison time, a small fine, and two years of probation. This was an amazing day for the lawyers and interpreters of Thailand Bail, as well as our client, who avoided a possible 50 years in prison for this case. The defendant’s embassy was also impressed, openly praising the work that Thailand Bail did for our client.
